I. Tesco Online Shopping

1. General Information

These General Terms and Conditions (the “GTC”) govern the use of the service designated as “Tesco Online Shopping” or “Grocery Home Shopping” (the “Service”), provided by Tesco and available on www.tesco.sk in the Online Shopping section or through a dedicated mobile application (the “Website”). The Tesco Hneď Service cannot be used through the Tesco Online Shopping mobile application.

The Service consists of presenting Tesco goods (the “Goods”) on the Website, enabling a registered and logged-in customer to create a shopping list containing Goods (the “Shopping List”), and arranging the delivery and purchase of the Goods. Goods displayed on the Website do not constitute a binding offer to purchase Goods under Slovak law.

The Service may be used only by a natural person aged 18 or over who has accepted these GTC and duly registered on the Website (the “Customer”). A legal entity, a natural person acting as an entrepreneur, or a person under 18 cannot be a Customer. Tesco may refuse delivery where, having regard to all circumstances, the purchase was not made for a household or an individual.

II. Customer Registration

1. Registration Form

A Shopping List may be created, delivery may be ordered and Goods may subsequently be purchased only after the Customer duly completes the registration form on the Website. The Customer must provide all data required for creating future Shopping Lists and ordering delivery, including name and surname, exact delivery address, telephone number, email address to be used as the login name, password, confirmation that the Customer has read the GTC and the Privacy and Cookies Policy, and acceptance of both documents (the “Registration”). The Customer agrees that the information under Section 15(1) of Act No. 108/2024 Coll. on Consumer Protection, as amended, may be provided on a durable medium other than paper.

The Customer must provide information that is current, true, accurate and complete. Following Registration, an account will be created on the Website through which the Customer may create Shopping Lists and order delivery within the Service (the “Account”).

2. Clubcard

A Customer registered in the Tesco Clubcard loyalty programme may link the Clubcard account when registering an Account by entering the Clubcard number. A Customer who does not yet have Clubcard may choose to obtain one during Registration and it will be automatically added to the Account.

When the Customer pays for accepted Goods, Clubcard points corresponding to the price of the accepted Goods at the time of delivery will be credited to the Customer’s Clubcard account. If the Customer does not accept certain Goods or returns them within the applicable period, the corresponding points will be deducted.

For the Tesco Hneď Service, Clubcard points for purchases will be credited within one month of the relevant purchase. No other Clubcard benefits are provided for Tesco Hneď purchases. Clubcard prices do not apply and Clubcard vouchers or coupons cannot be redeemed through the Tesco Hneď Service.

3. Updating Data

If data supplied during Registration changes, the Customer must update it upon the next login through “My Account” or through the Customer Helpline. The Customer Helpline is a free technical-support line for technical issues, errors, non-functionality or reduced functionality of the Website.

Tesco is not liable for consequences resulting from false or incomplete information supplied during Registration, failure to update information, or disclosure of the login name or password to third parties by the Customer.

4. Expiry and Cancellation of the Account

The Customer may request cancellation of the Account through any contact listed at https://tesco.sk/kontakty/ or may cancel it through the Tesco Online Shopping mobile application after logging in and selecting “Cancel account”. Tesco may cancel the Account without stating a reason or informing the Customer where it reasonably suspects that the Customer breaches these GTC or applicable law, demonstrably abuses the Service or acts contrary to accepted standards of conduct, or carries out activities that may constitute unauthorised interference with the Website or threaten its operation.

Registration expires upon the Customer’s death or when Tesco ceases providing the Service. Provisions which by their nature are intended to survive remain unaffected.

III. Website

1. Copyright

Tesco owns and operates the Website and is entitled, under applicable intellectual-property laws, in particular Act No. 185/2015 Coll., the Copyright Act, to exercise intellectual-property rights relating to the Website, including its content, visual appearance, design, images and databases.

Photographs of Goods are illustrative and may differ slightly from the actual Goods. Product photographs and descriptions are supplied by manufacturers, suppliers or Tesco. All information on the Website, including trademarks, photographs, descriptions and applications, is protected by law. Any unauthorised use, whether in whole or in part, constitutes an infringement.

2. Technical Requirements

To use the Service, the Customer’s device must have broadband internet access, a browser supporting CSS and JavaScript, enabled cookies and pop-ups, an operating system and an active email address. Tesco is not responsible for the proper functioning of third-party services, including the internet connection.

3. Use and Administration of the Website

The Customer and any other person must use the Website in accordance with its purpose, these GTC, accepted standards of conduct and Slovak law, and must refrain from activities that may disrupt its proper operation. In particular, they must not:

  • damage Tesco’s reputation or third-party rights;
  • interfere with or prevent use of the Website by other Customers;
  • interfere with the Website’s content, security or technical operation;
  • use the Website to distribute unsolicited or chain messages;
  • send viruses or other dangerous or harmful programs to the Website;
  • create false messages in order to impersonate a Customer; or
  • attempt to access another Customer’s Account.

Tesco may cancel the relevant Account. The Customer is fully responsible for actions carried out through the Account and must inform Tesco without undue delay of any suspected third-party misuse. Tesco may block the Account or require the Customer to change the password where justified concerns exist.

Tesco regularly undertakes activities to improve the Website. Errors or technical problems may occur. The Customer should report them through the Customer Helpline at 0800 222 333, through the customer form at www.tesco.sk or via live chat. Tesco will take steps to restore proper operation. Tesco may temporarily restrict access for technical improvement, maintenance or updating without prior notice.

Tesco is not liable for damage or loss of profit directly or indirectly resulting from interruption of the Website, unauthorised interference, incompatibility with the Customer’s hardware, software or internet connection, or technical problems, errors and connection failures.

IV. Shopping List and Order Confirmation (not applicable to Tesco Hneď)

Following successful Registration, the Customer may log in using the login name and password, which are confidential. The Customer is responsible for actions of third parties arising from disclosure of those credentials. Once logged in, the Customer may use available Service functions, in particular create a Shopping List and order delivery. Tesco sends confirmation of the Shopping List to the email address supplied during Registration.

A Shopping List may be created 24 hours a day, seven days a week. Tesco does not deliver on 1 January, Easter Sunday, 24, 25 or 26 December or on other public holidays when Tesco stores are closed. Tesco may designate additional non-delivery days by prior notice on the Website.

For next-day or another available future delivery, the Shopping List must be confirmed no later than 23:45 on the preceding day. The same deadline applies to changes, cancellation and the packaging option.

When creating a Shopping List, the Customer may choose delivery in shopping bags, subject to a flat fee disclosed before confirmation, or delivery without shopping bags, using the Customer’s own bags or other means. Counter-service meat and meat products, fish, detergents and other Goods requiring packaging for hygiene reasons will be packaged in accordance with law without charge, and the Customer will have sufficient time to accept the Goods.

By creating a Shopping List, the Customer makes a proposal for the delivery of Goods displayed on the Website. After the Customer confirms the Order, Tesco sends an electronic confirmation to the email address registered for the Account (the “Electronic Order Confirmation”).

The Customer may amend the Order under these GTC. An amendment proposed by the Customer may result in a change to the price in accordance with the prices applicable on the date of amendment. For Tesco Hneď, the Customer cannot amend the Order after submission and acceptance by Wolt acting on behalf of Tesco through an Order-confirmation email.

The Customer agrees to the use of distance-communication means to conclude the purchase contract and bears the associated costs. No act performed by Tesco before delivery may be treated as acceptance of the Customer’s proposal. The Customer may amend or cancel the Shopping List through the Account or Customer Helpline. After 23:45, cancellation is possible only through the Customer Helpline.

For same-day delivery, the Customer may cancel or amend the Order by 08:44 for delivery between 13:00 and 18:00, or by 12:44 for delivery between 18:00 and 22:00.

For home delivery, the Customer may order no more than 24 units of each item sold by unit. Tesco may refuse and cancel an Order exceeding 120 kg or 200 items and will inform the Customer. These capacity limits do not apply to Click+Collect.

For Goods sold by weight, Tesco may deliver a weight differing by up to +/-10%, depending on the Goods. The Customer may reject Goods where the deviation exceeds 10%. Where the Customer orders units rather than weight, the price is calculated using the actual weight of the delivered units.

V. Creating a Shopping List, Product Availability and Substitute Products

Creating a Shopping List means selecting products shown on the Website and placing them in the basket. It does not itself constitute an online order and the Customer is not obliged to purchase the selected products.

Website availability may differ from availability at a particular store and depends on stock at the serving store on the delivery date. Tesco does not guarantee continuous availability and may set maximum purchase limits to ensure availability for as many Customers as possible.

If selected products are unavailable and the Customer opted to receive substitutes, Tesco will use its best efforts to offer products with characteristics and prices as close as possible to the original selection. The Customer may opt in or out at item or basket level. The price, pack size and brand may differ. Substitute products will be listed in the Electronic Delivery Note sent in advance by email.

The Customer may return an unsatisfactory substitute to the Delivery Partner without payment. For online card payments, the amount charged for the substitute will be refunded in accordance with Article VI, Section 3.

VI. Price of Goods and Payment Terms

1. Price of Goods

Prices on the Website are stated in euros including applicable VAT and excluding delivery. The current price is displayed after login and may be changed by Tesco at any time without stating a reason. The price is communicated before conclusion or amendment of the purchase contract. The Customer is informed of the purchase price upon confirmation and through the Electronic Delivery Note.

Where the Customer proposes an amendment, Tesco may submit a counter-proposal changing the price of individual items. The Customer is not required to accept it. If not accepted, the original proposal, including the original price, remains in force. If accepted, the proposal and the price of the affected Goods are amended.

Upon delivery, the Customer may propose an amendment by rejecting some or all items, which Tesco accepts. The Customer may also exercise the right of withdrawal under Article XI. Prices of weighed Goods may change according to the actual permitted weight deviation. Where units are ordered instead of weight, price is calculated by actual weight.

Tesco supplies a proof of purchase stating Tesco’s business name, registered office, Company ID and registration details, the establishment address, date of sale, name and quantity of Goods, item prices and the total paid (the “Proof of Purchase”). For returned Goods, the Customer may request a corrective tax document at tesco_sk@tesco.com, stating the Order number. It will be sent by post to the registered address.

2. Delivery Price

Delivery is not included in the price of Goods. A delivery price is payable separately for each Order even where several Orders share the same address, date and time. It depends on the day and delivery time slot. The applicable price or free-delivery information is displayed after the Shopping List is created (the “Delivery Price”).

3. Payment Terms (not applicable to Tesco Hneď)

The Customer may pay online or at the Customer’s door using Visa, Visa Electron, MasterCard or Maestro. If a card is declined during transaction verification, the Customer may use another card or switch to payment on delivery. If payment cannot be collected on the delivery date, the Customer will receive an SMS about payment on delivery.

The Customer must activate online payments and verify that the card remains valid until delivery. Tesco may refuse delivery if the card is invalid on the delivery date.

For online payment, transaction verification occurs when the Order is submitted. The authorised amount is increased by 15% to cover potential substitutes. Before delivery, the bank releases only the amount corresponding to the Goods actually delivered. Full authorisation occurs on the delivery date.

If an Order is cancelled in accordance with these GTC, no amount will be charged. If cancellation occurs on the delivery date after payment has been collected but before delivery, Tesco refunds the full amount; crediting depends on the bank’s processing. Cash, meal vouchers, gift vouchers and other valuables cannot be used.

4. Returnable Deposit Packaging

The price of Goods in returnable deposit packaging includes the deposit, the amount of which is displayed with the Goods. The packaging may be returned during opening hours at any Tesco establishment, having regard to the assortment sold there. It cannot be returned to the Delivery Partner and bottle-return coupons cannot be redeemed through the Service.

VII. E-coupons (not applicable to Tesco Hneď)

1. Standard Conditions

An E-coupon received from Tesco in a leaflet, press insert, email or otherwise may be redeemed as a discount under these standard conditions. The discount amount is shown on the E-coupon.

2. Use of E-coupons

E-coupons in printed, electronic or other form may be used only for purchases through the Service at www.tesco.sk/potravinydomov. Validity and duration are stated on the E-coupon. The Customer applies the coupon by entering its code in the Order Summary. Eligibility may be verified by supporting evidence.

Use is verified automatically. By using an E-coupon, the Customer accepts these conditions. Tesco may cancel or change the conditions at any time. E-coupons are Tesco’s property, are personal to the original recipient and are non-transferable unless stated otherwise. They may not be copied, reproduced, distributed, disposed of or published. Unauthorised coupons are invalid and confer no property rights.

3. Permitted Use

  • Unless expressly stated otherwise, an E-coupon may be used only once by the Customer, recipient or household.
  • It may not be combined with another E-coupon or used for a service other than the Service.
  • It cannot be exchanged for cash or used to purchase gift vouchers.

4. Excluded Goods or Services

E-coupons cannot be used to purchase tobacco, tobacco products, infant food or prescription medicines (the “Excluded Goods”). Tesco may identify further exclusions, which will be stated on the coupon or Website. Excluded Goods and services are not counted towards the Shopping List or qualifying purchase and receive no discount.

5. Minimum Purchase Requirement

Use may require a purchase of designated Goods or services at the minimum value shown on the E-coupon (the “Minimum Purchase”). An individual purchase means actual acceptance and payment. Excluded Goods, fees and other amounts not paid directly for Goods are excluded.

6. Discount Calculation

The Minimum Purchase and discount are shown on the E-coupon. Once all conditions are met, the discount is deducted from the total purchase price. Prices include VAT. Fees are excluded unless the E-coupon states otherwise.

7. Security and Anti-fraud Measures

By using an E-coupon, the Customer represents that they are the lawful recipient and holder and are acting in good faith. Where Tesco reasonably suspects improper acquisition, fraud, an offence or other unlawful conduct, it may refuse or cancel the coupon and take appropriate additional measures.

8. Limitation of Liability

Tesco is not liable for financial loss resulting from refusal, cancellation or withdrawal of an E-coupon, inability to assert rights under it, or any other reason.

9. Other

Tesco may modify or terminate E-coupons or change their conditions at any time without prior notice.

VIII. Click+Collect Service

1. Description and Conditions

Click+Collect is ancillary to the Service and allows Customers to collect ordered Goods at a Collection Point instead of home delivery. Use is subject to availability in the Customer’s registered area. Availability and price are shown while Order requirements are entered. Collection Points are marked with the Click+Collect logo. Article IX applies as appropriate, subject to the specific collection rules below.

2. Collection at the Collection Point

Only a person aged over 18 who placed the Order may collect Goods by giving the Order number. Tesco may request an identity document to verify age and identity and will not release Goods if entitlement is not proven.

If selected products are unavailable and substitutes were requested, Tesco will use its best efforts to offer products as close as possible in characteristics and price. The Customer may opt in or out at item or basket level. Differences in price, pack size and brand are possible and substitutes will appear in the Electronic Delivery Note.

The Customer may return an unsatisfactory substitute to the colleague at the Collection Point. Online card payments are refunded in accordance with Article VI, Section 3. On collection, the Customer may reject Goods in whole or in part, which Tesco accepts. Articles VI and XI apply as appropriate.

IX. Delivery of Goods (not applicable to Tesco Hneď)

1. Delivery Conditions

Delivery takes place on the days and at the times displayed in “Book a slot”. Tesco delivers no earlier than the first available date and time following confirmation. Tesco will use all efforts reasonably expected to deliver at the agreed time but is not liable for delay caused by force majeure or other unforeseeable events such as accidents or traffic congestion.

The purchase contract is concluded only when the Customer accepts the Goods and pays the purchase price. Before acceptance, the Goods are delivered to the Customer’s door and may be inspected.

2. Substitute Items

Tesco does not guarantee availability. If ordered Goods are unavailable, Tesco may offer substitute Goods with similar or equal properties and price. Substitute Goods are identified in the Electronic Delivery Note emailed on the delivery date. The Customer may reject all or part of them and rejected Goods are excluded from payment, including where card details were supplied in advance. Promotional Goods may not be delivered if sold out.

3. Delivery of the Shopping List

Tesco delivers only to areas shown in “Where we deliver” after entry of a postcode. Goods are delivered to the door of the apartment building or family house stated as the delivery address. The Customer may request delivery to a particular floor. The Delivery Partner will use reasonable efforts provided entry is permitted, access is unobstructed and the request is not unreasonable or liable to endanger health, life, Goods or other property.

Tesco may refuse further deliveries where, three or more times in one calendar month, a Customer was absent from the agreed place and time or accepted none of the delivered Goods, preventing conclusion of the purchase contract.

Tesco may check data in the Account, including the delivery address, telephone number and previous Shopping Lists, and may refuse delivery where it reasonably suspects an Order breaches these GTC. The service charge is payable separately for each Shopping List even where date, time and address are identical.

Tesco may verify the age of the recipient. If the person is under 18 and no eligible alternative recipient is present, Tesco will refuse handover, particularly for alcohol, cigarettes and similar Goods. The Customer may authorise only a person aged over 18. Alcohol cannot be handed to a person under 18 or under the influence of alcohol.

X. Tesco Hneď Service

1. Description of the Tesco Hneď Service

The Tesco Hneď Service is an ancillary service provided in connection with the Service. It enables Customers to create and place Tesco orders through websites operated and managed by Wolt Česko s.r.o., Company ID No. 07030550, with its registered office at Bubenská 1477/1, 170 00 Prague 7, registered in the Commercial Register maintained by the Municipal Court in Prague, File No. C 293350 (“Wolt”).

The Customer does not need a separate Tesco or Wolt account and may access the Tesco Hneď Service using credentials associated with the Account. Availability is geographically limited to selected delivery areas in the Slovak Republic and is displayed on the websites operated and managed by Wolt to which the Customer is redirected (the “Tesco Hneď Website”).

2. Ordering Process

After selecting the Tesco Hneď Service and logging in, the Customer is redirected to the Tesco Hneď Website. Available products and applicable prices are displayed. The Customer may request substitutes for unavailable products. The Customer creates, completes and pays for the Order directly on the Tesco Hneď Website.

The Customer may not amend the Order after it is submitted and accepted by Wolt acting for Tesco through an Order-confirmation email. Tesco may cancel all or part of the Order for technical reasons or technical failure. Tesco or Wolt acting for Tesco may also cancel due to limited delivery capacity.

3. Fees and Payments

The delivery fee and all other fees, including any minimum-basket or bag fee, are displayed at checkout. The Customer pays before confirmation using Visa, Mastercard, American Express, Apple Pay or Google Pay. Card data are encrypted to reduce the risk of unauthorised access or disclosure.

Payment is provided by Wolt Oy, Pohjoinen Rautatiekatu 21, 00100 Helsinki, Finland, Business ID 2646674-9, VAT No. FI26466749 (“Wolt Oy”), through a third-party provider. Payment complaints or claims may be addressed to support@wolt.com.

When the transaction is authorised, the price is increased by 20% to cover possible substitutes and weighed Goods. Before delivery, the bank releases only the amount corresponding to Goods actually delivered. The Customer must activate online card payments and ensure the card remains valid until delivery. If invalid on the delivery date, the Goods will not be delivered and the purchase contract will be cancelled.

4. Delivery and Product Availability

After submission, the Customer receives an estimated delivery time. If Goods are unavailable or cannot be delivered and substitutes were not selected, Tesco may cancel the unavailable part or the entire Order and related purchase contract. The final price is reduced accordingly. If no products are available or deliverable, Tesco may cancel the purchase contract in full.

The Customer provides a delivery address in Slovakia. Goods are delivered to the main entrance. The Customer may request delivery to a specific floor or apartment. Tesco, represented by Wolt, will use reasonable efforts provided the courier is allowed entry, access is unobstructed and the request is not considered unreasonable or harmful to health.

Tesco, represented by Wolt, will use best efforts to deliver at the requested time but is not liable for delay caused by circumstances it could not reasonably control without disproportionate effort. It may verify age, particularly for alcohol, by inspecting an identity document. If age is not proven, Goods will not be delivered unless handed to another eligible person.

If no authorised recipient is present, the driver leaves notice of the delivery attempt and instructions to contact Customer Support for redelivery. Where failure is not attributable to Tesco, Tesco is entitled to fees for the attempt. A further fee applies to redelivery.

Goods may be delivered and the purchase contract concluded only during the opening hours of the selected dispatching store, as shown during ordering. Orders are delivered in chargeable shopping bags, with the fee displayed before confirmation.

XI. Withdrawal from the Contract

The Customer may withdraw without giving a reason within 14 days after delivery. The Customer must notify Tesco by an unequivocal statement sent to tesco_sk@tesco.com or TESCO STORES SR, a.s., Central Office, Cesta na Senec 2, 821 04 Bratislava, and may use the model withdrawal form. The deadline is met if notice is sent before expiry.

After withdrawal, the Customer must return the Goods within 14 days in the same condition as purchased: undamaged, unopened and complete. Goods protected against opening must not be returned after removal of protective packaging or marking; otherwise Tesco may claim damages or restitution of unjust enrichment.

Transport already performed cannot be withdrawn from and its cost is borne by the Customer. If delivery was reduced to zero under a promotion and the return means the conditions are no longer met, the refund is reduced by the relevant delivery amount shown in the Electronic Delivery Note. Where the Customer uses another method to return Goods, return costs are compensated according to the Service delivery price list. Refunds are made without undue delay to the bank account used for payment and no later than 14 days after Tesco receives notice of withdrawal.

The refund is made after all withdrawal conditions are fulfilled and is calculated using the Proof of Purchase. Tesco accepts the Goods back and returns the price paid. Clubcard points awarded for returned Goods are deducted.

The right of withdrawal does not apply to Goods sealed for health-protection or hygiene reasons where the seal was broken after delivery, Goods liable to rapid deterioration or spoilage, or the fee for the Tesco Online Shopping Service.

XII. Complaints Procedure

Complaints concerning defects in Goods are governed by Tesco’s Complaints Procedure. Tesco may also allow complaints, submissions and claims through other channels that facilitate resolution while preserving statutory rights. Any enhanced arrangements will be published on the Website.

For Tesco Hneď, Customer Support is also available at support@wolt.com or through Wolt live chat within the order-tracking screen.

XIII. Alternative Dispute Resolution for Consumer Disputes

Alternative dispute resolution (“ADR”) seeks an amicable settlement between a consumer and trader and aims to prevent court proceedings. If the Customer is dissatisfied with Tesco’s response to a request for redress and the attempt to resolve the dispute is unsuccessful, the Customer may submit a proposal to an ADR entity, such as the Slovak Trade Inspection. Further information is available on the Slovak Trade Inspection website.

XIV. Supervisory Authorities over Tesco

The supervisory authorities are the public-health administration authorities; the State Veterinary and Food Administration in relation to the offer and sale of food; the Public Health Authority of the Slovak Republic and regional public-health authorities in relation to cosmetics; and the Slovak Trade Inspection in relation to the offer and sale of products and provision of services.

XV. Personal Data Protection

The relevant provisions are set out in the applicable Tesco Privacy Policy available at www.tesco.sk/ochrana-sukromia/.

XVI. Contact

For questions, concerns, opinions or comments, contact Tesco through the contacts at https://tesco.sk/kontakty/, the live-chat function at www.tesco.sk or the toll-free number 0800 222 333. For Tesco Hneď, Customer Support is available at support@wolt.com or through Wolt live chat in the order-tracking screen.

XVII. Final Provisions

Rights and obligations not governed by these GTC are subject to the laws applicable in the Slovak Republic. Disputes arising from the Service that are not settled amicably will be decided by the competent court of the Slovak Republic.

Tesco may amend these GTC. Amendments may not violate or restrict rights arising from Shopping Lists or ordered deliveries made before the amendments take effect. Tesco may amend the GTC particularly because of changes in marketing strategy, market conditions for similar services, technological development, increased Tesco costs or inflation according to the Statistical Office of the Slovak Republic, legislative changes, decisions of the Government of the Slovak Republic, public-administration authorities or EU bodies, or force majeure such as natural disaster, virus or war.

Amendments take effect on publication on the Website. Tesco may also notify the Customer by email, including a link to the amended text. If the Customer disagrees, the Customer may cancel the Account.

These GTC are available on the Website, particularly during Registration, after login, and while creating a Shopping List and confirming an Order. They are also available in English. In the event of discrepancies, the Slovak version prevails.
